40 Years of Zen — Program Booking, Billing, Cancellation and Rescheduling Policy

This policy forms part of the 40 Years of Zen Main Website Terms and Conditions and is a contract between you and 40 Years, Inc., a Delaware corporation d/b/a 40 Years of Zen ("we," "us," "our"). By reserving a program you confirm that you have read and accepted this policy.

This policy applies to programs booked with 40 Years of Zen through our main website at 40yearsofzen.com (and any precursor domain, including https://40yoz.framer.website/).

It does not apply to products bought from our online store at https://shop.40yearsofzen.com. Coffee, supplements, devices, accessories and Satoria memberships are governed by the Shop Terms of Service and the Shop Refund Policy published on the Shop.

Deposits and program fees are non-refundable. Please read the cancellation and rescheduling terms below carefully before you book.

1. Program fee and what it includes

The price of our 5 Day Master Program is $16,000. The program fee includes:

•      The five-day neurofeedback training program;

•      An individual brain map and review;

•      POD and CAP training;

•      Facilitation throughout the program;

•      Lunch and dinner daily, created by a private chef; and

•      Supplements for the week.

 

The program fee does not include travel, flights, ground transportation, accommodation, breakfast, personal expenses, insurance, or any product, service or add-on not listed above. You are responsible for arranging and paying for those separately, and we recommend you obtain travel insurance that covers cancellation, because program payments are non-refundable.

Prices are quoted and charged in U.S. dollars and are exclusive of any applicable taxes, which will be added where required. We may change published prices at any time, but a change will not affect a booking we have already accepted.

2. Booking and deposit

Programs are reserved with the payment of a $5,000 deposit, which is applied to the program fee. The deposit is due immediately when you make your reservation for a program week. We will charge your credit card or debit your bank account, depending on how you elect to pay, immediately for the value of the deposit. Your date is not held until the deposit has been received.

A booking is confirmed only when we send you a written confirmation. We may decline or cancel a booking, and will refund amounts paid for it, where we cannot verify your payment or identity, where a listed price or program detail was plainly incorrect, or where the program is not appropriate for you following health screening (see Section 8).

3. Balance and payment dates

The balance of the program fee is due 30 days before the start date of your reserved program. We will send an invoice for the balance to the email address you provided when you made the reservation. You may click the link in the invoice to pay online by credit card or by "e-check" online check payment.

If you make a reservation within 30 days of the start date of the program, you may still complete your reservation with payment of a deposit, but the remaining balance is also immediately due.

We reserve the right to release your reserved date and treat the booking as cancelled under Section 5 if the balance is not paid by the due date.

4. Payment authorization, failed payments and chargebacks

•      Authorization. By providing a payment method you authorize us and our payment processors to charge that method for the deposit, the balance and any administration fee properly due under this policy.

•      Failed payments. If a payment is declined or a bank payment is returned, we will notify you and may retry. You remain responsible for the amount due and for any fee our bank charges us for a returned payment, which we may pass on to you.

•      Chargebacks. If you initiate a chargeback or payment dispute for an amount properly due under this policy, we may suspend or cancel your booking and pursue the amount owed, together with reasonable costs of recovery. Please contact us first — most issues are resolved faster directly.

 

5. Cancellation by you

Deposits and program fees are non-refundable. If you cancel your attendance, you forfeit the amounts you have paid, subject only to the rescheduling rights described in Section 6 and to any right that cannot be waived under applicable law.

A cancellation or rescheduling request is effective when we receive it in writing at info@40yearsofzen.com. Please put "Cancellation" or "Reschedule" and your program date in the subject line.

6. Rescheduling

You may move your program to a different date instead of cancelling. What applies depends on when we receive your written request:

You may transfer your deposit and any payments to a new date at no charge. The new date must be within 12 months of your original date and is subject to availability.

7 to 30 days before your start date

You may reschedule, and an administration fee of $5,000 will be added to your final balance. If you choose to cancel instead, you forfeit your entire fee.

Fewer than 7 days before your start date

All payments received are forfeited and the program may not be rescheduled.

 

Unless we agree otherwise in writing, a booking may be rescheduled once. A rescheduled booking is subject to the program fee in effect on the new date if that fee has increased.

7. Transfers, no-shows and early departure

•      Transferring to another person. Bookings are personal to you and may not be transferred to another person without our prior written consent, which we may grant at our discretion subject to the new participant completing health screening and signing our participation documents.

•      No-shows. If you do not attend and have not given notice under Section 6, all payments are forfeited.

•      Leaving early. If you leave a program early for any reason, no refund or credit is given for the unused portion.

 

8. Eligibility and health screening

Participation requires you to complete our intake and health screening and to sign our participation agreement, informed consent and release. If, following screening, we determine in good faith that the program is not appropriate or safe for you, we will tell you promptly and refund all amounts you have paid, including the deposit. If you withdraw after being cleared, or you decline to complete screening or sign the required documents, the standard terms in Sections 5 and 6 apply.

You are responsible for giving complete and accurate information during screening. If material information is withheld and we cannot safely proceed once you arrive, no refund is due.

9. Changes or cancellation by us

We may need to change the date, location, staffing or format of a program, or cancel it, including because of illness, equipment failure, severe weather, natural disaster, government action, or other circumstances beyond our reasonable control.

If we cancel or materially reschedule a program, you may choose either (a) a transfer of everything you have paid to an alternative date, with no administration fee, or (b) a full refund of all amounts you have paid us for that program. That is our entire liability for a change or cancellation by us. We are not responsible for travel, accommodation or other third-party costs you incur, which is why we recommend travel insurance.

10. Relationship to our other terms

This policy is part of, and should be read with, the Main Website Terms and Conditions and the Main Website Privacy Policy. Disputes relating to a booking are subject to the governing law, dispute resolution and binding individual arbitration provisions of the Main Website Terms and Conditions, which include a class action and jury trial waiver and a 30-day right to opt out of arbitration. Please read them before you book. If you sign a separate participation agreement, that agreement governs the program itself; this policy governs booking and payment.

Nothing in this policy limits any right you have that cannot be limited or waived under applicable law.
